'Transformers 3' Producers Cleared Of Wrongdoing In Set Crash

Paralyzed extra's lawsuit is still pending.

The producers of "Transformers 3" have been cleared of any wrongdoing in connection with an accident on the Indiana set that left an extra partially paralyzed, according to TMZ.

Gabriella Cedillo was injured September 1 during an on-set car crash in which a tow cable snapped and sliced through her skull. The accident left her with permanent brain damage and paralyzed on her left side. Cedillo's family has filed a negligence lawsuit against Paramount Pictures (which, like MTV, is owned by Viacom) and DreamWorks.

But a representative with the Indiana Occupation Safety and Health Administration told TMZ that "Transformers" producers followed proper procedures during the stunt and that the accident was "due to the failure of a weld connecting a car to a cable. The weld was made by a certified welder and all necessary safety precautions were in place."

"No citations or fines will be issued," the rep said. "This was an unfortunate and unforeseeable accident."

While the IOSHA has cleared producers, the status of Cedillo's lawsuit, in which her family is seeking unspecified damages in excess of $50,000, is still pending. Concerns about the safety of the "Transformers" set began to creep out in the wake of her injury, according to a Deadline Hollywood report. Cedillo's suit, meanwhile, contends that producers were negligible in a variety of respects from failure to use proper materials to failure to "properly train and safeguard 'extras' on the filming."

The film, which is rumored to be titled "Transformers: The Dark of the Moon" (Paramount has not yet made an official announcement), is set to hit theaters May 17, 2011.
